These Terms of Service ("Terms") govern your access to and use of the Gelly application and associated services (collectively, "Service"), provided by [Your Company Name] ("we," "us," or "our"). 1. Intellectual Property Rights

1.1 User Content: All data, including notebooks, files, and other materials entered, created, or generated on Gelly by you remain your intellectual property. Such data will not be considered "published" through its use of the Service, and you retain the ability to patent or publish your work.

1.2 License to Gelly: By using Gelly, you grant us a limited, revocable, non-exclusive license to use, host, and store such data as necessary to provide the Service. This includes situations where you create shared links or invite team members to collaborate on projects.

2. Third Party Software

9.1 Gelly utilizes seqkit for sequence search, which is licensed under the MIT license and available free of charge. If you publish results obtained using Gelly that include data processed by seqkit, you are required to cite seqkit as follows:

3. User-Generated Content

3.1 You are solely responsible for the content you input into Gelly. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and to authorize us and other users to use and display your content as necessary.

3.2 Filtering: Gelly uses automated systems to filter uploads to prevent unlawful, pornographic, or personally invasive images and videos from being stored. Content flagged by these systems may be blocked, and repeat offenders may be subject to suspension as outlined in the Termination clause.

4. Prohibited Uses

You agree not to use the Service:

• For sending data not appropriate for its intended analytical use (e.g., sending textual data to a sequence analyzer).
• To transmit spam or engage in other forms of unsolicited usage.
• To misuse our data storage for non-research purposes, including storing copyrighted movies, personal images, or memes.
• In any manner that violates applicable laws or regulations.
• Within countries subject to international sanctions.
• To develop or research illegal pathogens. Note: Any suspicious activity may be reported to law enforcement.

5. Termination

5.1 We may terminate or suspend your access to the Service without prior notice for violating these Terms. Upon suspension, your account will be placed in a read-only state where you can view but not edit or add new content.

6. Licensing and Limitations

6.1 We grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service. This includes limited access to high-performance computation time, subject to the restrictions of your subscription plan.

6.2 You agree not to copy, modify, reproduce, translate, localize, port, or otherwise create derivative works of the Service, except as explicitly permitted in these Terms.

7. Fees and Payments

7.1 The Service is available under a subscription model. Fees are detailed via in-app purchases or our website and are subject to change.

7.2 Refunds for computation time lost due to faults not attributed to the user may be requested, allowing for reallocation of resources to complete the intended tasks.

8. Limitation of Liability

8.1 Gelly is not liable for decisions made based on data generated by our Service. Users are responsible for validating their research results using independent methods. We provide support on data generation techniques to ensure reproducibility.

9. Data Security and Privacy

9.1 Data Storage: Data is stored unencrypted with third-party providers such as Digital Ocean (https://www.digitalocean.com/trust), Mixpanel, Apple, Google, Adapty, and Stripe. We use SSL/HTTPS to secure data in transit.

10. Governing Law and Dispute Resolution

10.1 These Terms are governed by the laws of Germany. Disputes arising under these Terms will be resolved in Schöffengrund, Germany.

11. Accessibility and System Requirements

11.1 Gelly is designed for devices running Android 13, iOS 16.1, and macOS that supports iOS apps. Users must ensure compatibility of their devices.

12. Amendments to These Terms

12.1 We reserve the right to amend these Terms at any time. Users will be notified of changes upon app launch and through an email notification.
